1. Acceptance of Terms
By downloading, installing, or using the Star Score App (the “App”), you (“User”) agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, you must not use the App. Star Score, LLC (“Company”) reserves the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the App constitutes your acceptance of the modified Terms.
2. License to Use the App
The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not use the App in any way that is unlawful or prohibited by these Terms.
3. User Obligations
a) Account Registration: To access the App, you must register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b) Security: The User is responsible for maintaining the confidentiality of User’s account credentials and are fully responsible for all activities that occur under your account. The Company is not liable for any loss or damage arising from your failure to secure your account.
c) Compliance with Laws: You agree to use the App in compliance with all applicable Federal, California and Washington State laws, regulations, and guidelines.
4. Prohibited Uses
You agree not to:
- Use the App for any commercial purposes without the prior written consent of the Company.
- Use any information obtained via the App to make any decisions whatsoever. (The App is for entertainment purposes only. Enjoy!)
- Engage in any activity that could interfere with, disrupt, or damage the App or its servers.
- Use any automated system, such as bots or scripts, to access the App.
- Reverse engineer, decompile, or disassemble any part of the App.
- Post, upload, or distribute any content that is unlawful, harmful, or infringing on the copyrights, patents or trademarks for Star Score, LLC or on the rights of others.
5. Intellectual Property
All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of the Company or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works based on this content without the prior written permission of the Company.
6. Privacy
Your privacy is very important to us. Please review the Star Score, LLC Privacy Policy.
7. Termination
The Company reserves the right to terminate or suspend your account or access to the App at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the App will immediately cease.
8. Disclaimers and Limitation of Liability
- Disclaimer: The App is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (e) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our App by any third party; or (f) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, or your violation of these Terms.
10. Governing Law
These Terms and your use of the App will be governed by and construed in accordance with the laws of the State of Washington without regard to its conflict of laws principles. You agree to submit to the personal jurisdiction of the courts located within the State of Washington for the resolution of any disputes.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding the use of the App and supersede any prior agreements between you and the Company related to the App.
